Terms of Use

1. Preamble

Nestora operates a mobile application (hereinafter “the Application”) and a website www.nestora.ch (hereinafter “the Site”) enabling individuals in the Geneva region and French-speaking Switzerland looking for personal and lifestyle services (hereinafter “the Clients”) to be matched with independent providers offering these services (hereinafter “the Providers”). The Application and the Site are collectively referred to below as “the Platform”.
These Terms of Use (hereinafter “the Terms of Use”) govern access to and use of the Platform by any person, whether Client, Provider or simple visitor (hereinafter “the User”). By creating an account or using the Platform, the User acknowledges having read, understood and accepted these Terms of Use in full.

2. Definitions

  • Nestora : a sole proprietorship with its registered office at Rue du Môle 42B, 1201 Geneva, publisher of the Platform.
  • Platform : the Nestora mobile Application and the www.nestora.ch Site.
  • Client : an adult natural person using the Platform to post service requests.
  • Provider : an independent natural person offering their services through the Platform.
  • Mission : a service agreed between a Client and a Provider following a match made through the Platform.
  • Services offered : babysitting, pet sitting, childcare (nanny), tutoring, music lessons, IT support, personal training, beauty treatments, landscaping, and other services to come.

3. Nestora's role

Nestora acts exclusively as a technical matching intermediary. Nestora is neither the employer, nor the agent, nor the principal of the Providers and is not a party to the service contract concluded between the Client and the Provider.
Nestora is never involved in the payment for the service and receives no commission on the sums exchanged between the Client and the Provider. The remuneration for the Mission is agreed and paid directly between the Client and the Provider, outside the Platform.
Nestora guarantees neither the quality, nor the conformity, nor the safety, nor the legality of the services performed by the Providers. The checks Nestora carries out on Provider profiles (identity verification, criminal record for certain services, insurance certificates, certifications) constitute reasonable diligence but do not release either the Client or the Provider from their own checks and responsibilities.

4. Eligibility and account creation

Use of the Platform as a Client is reserved for adult natural persons (18 years and over) with capacity to contract under Swiss law.
Use as a Provider is open from the minimum ages indicated per service category in the Application. Authorised minors (from 15 for babysitting and pet sitting, 16 for tutoring) may only register with the express consent of their legal representatives.
The User undertakes to provide accurate, complete and up-to-date information when creating their account and to keep it updated. Any false declaration may result in the immediate suspension or termination of the account.
The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their account. Any fraudulent use detected must be reported without delay to contact@nestora.ch.

5. How the service works

The Client posts a Mission request via the Application, specifying the nature, location, expected characteristics and, depending on the service, the date. The request is brought to the attention of eligible and geographically relevant Providers.
Interested Providers can declare themselves available. The Client then chooses, among the available Providers, the one they wish to retain. The Mission contract is formed between the Client and the Provider at the time of this confirmation, without Nestora being a party to it.
Contact details (phone, email, full address) are only exchanged between the Client and the Provider after final confirmation of the Mission. Before this confirmation, the Provider only has access to the postcode and locality of the Mission, to the exclusion of the Client's full identity, precise address, photo and the first names of the members of their household.

6. Client obligations

The Client undertakes to:
  • provide the Provider with the information necessary for the proper execution of the Mission (allergies, particularities, instructions);
  • welcome the Provider in conditions that are safe and compatible with respect for their dignity;
  • pay the Provider directly the agreed remuneration, within the timeframes and according to the terms accepted between the parties;
  • not seek to bypass the Platform for subsequent Missions, when they were matched with a Provider through Nestora;
  • cancel any request that has become moot with reasonable notice.

7. Provider obligations

The Provider works exclusively on a self-employed basis. They remain solely responsible for complying with their legal, tax and social security obligations (AVS/AHV, taxes, mandatory and optional insurance, residence and work permits, professional authorisations).
The Provider undertakes in particular to:
  • comply with the eligibility conditions (age, qualifications, certifications, criminal record, training) specific to each service category, as set out in the service-specific terms accepted in the Application;
  • arrive at the agreed time, in neat attire and behaving professionally;
  • respect the privacy and confidentiality of the Client and their entourage;
  • take out and maintain insurance appropriate to their activity (personal liability and, where applicable, professional liability);
  • report any incident without delay to the Client and, if necessary, to the emergency services;
  • not solicit or accept, outside the Platform, subsequent services from a Client met through Nestora with the intention of circumventing these Terms of Use.
The Provider acknowledges that the service-specific terms, presented and accepted when activating each service in the Application, form an integral part of this contract.

8. Provider vetting

Nestora may carry out, depending on the service category, checks on Provider profiles: verification of an identity document, review of a recent criminal record extract, verification of a professional liability insurance certificate, and checking of specific certifications (first aid, diplomas, authorisations). These checks may take place at registration or at any time during use of the Platform, and Nestora may suspend an account pending the requested documents.
These checks constitute reasonable diligence. They do not prejudge the quality, safety or outcome of Missions, and cannot engage Nestora's liability for failures attributable to the Provider.

9. Cancellations

Any cancellation by the Client or the Provider must be notified via the Application as soon as possible and at least 24 hours before the start of the Mission, except in cases of force majeure.
In the event of repeated late cancellations or unjustified absences, Nestora reserves the right to suspend or terminate access to the account concerned. The conditions for refunding used Mission credits are set out in the Terms of Sale.

10. Conduct and prohibitions

The User shall refrain in particular from:
  • any behaviour constituting harassment, an affront to dignity, discrimination or violence;
  • any attempt at fraud, identity theft or manipulation of the Platform;
  • any communication containing unlawful, defamatory, racist, sexist content or content contrary to public decency;
  • any unauthorised commercial exploitation of the Platform's content, data or features;
  • any circumvention of the Platform in order to avoid subscription or credit fees, when the initial match was made through Nestora.

11. Ratings, reviews and reports

At the end of a Mission, the Client and the Provider can each give the other party a rating. Ratings cannot be changed once submitted. Nestora reserves the right, in the event of a report, to hide or remove any rating or comment deemed manifestly inappropriate, untruthful or defamatory.
Any incident, abusive behaviour or serious breach can be reported via the Application's support section or by email to contact@nestora.ch.

12. Suspension and termination

Nestora reserves the right to suspend or terminate, without notice or compensation, a User's access to the Platform in the event of a serious breach of these Terms of Use, reported inappropriate behaviour, provision of inaccurate information, or fraudulent use.
The User may at any time delete their account directly from the Application (Support section → “Permanently delete my account”) or by request sent to contact@nestora.ch. Deletion is immediate and permanent; it is unavailable while a Mission is in progress. It does not give rise to a refund of subscriptions or credits already used and does not cancel the subscription managed by Apple, whose automatic renewal must be disabled separately from the Apple ID settings.

13. Intellectual property

All elements of the Platform (Nestora trademark, logo, design, texts, illustrations, source code, database) are protected by Swiss intellectual property law. Any reproduction, representation, adaptation or substantial extraction, in whole or in part, is prohibited without Nestora's prior written authorisation.
The User retains ownership of the content they publish on the Platform (photos, texts, descriptions). They grant Nestora a non-exclusive, free licence, limited to the performance of the service, to host, display and transmit this content to the other Users concerned.

14. Limitation of liability

To the fullest extent permitted by Swiss law, Nestora is only liable for direct damage resulting from gross negligence on its part. Its liability for slight negligence is excluded. Nestora's liability shall in no event exceed, per user and per calendar year, the amount actually paid by that user to Nestora over the last twelve months.
Nestora declines all liability for services performed by Providers, damage caused to persons or property during a Mission, disputes arising between Client and Provider, and temporary unavailability of the Platform.

15. Personal data

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Use.

16. Changes to the Terms of Use

Nestora reserves the right to amend these Terms of Use at any time, in particular to adapt to legal developments or new Platform features. Substantial changes will be notified to the User via the Application or by email at least 30 days before they come into force. Continued use of the Platform after this date constitutes acceptance of the new terms.

17. Governing law and jurisdiction

These Terms of Use are subject to Swiss law, excluding conflict-of-law rules. Any dispute relating to their formation, performance or interpretation falls under the exclusive jurisdiction of the ordinary courts of the canton of Geneva, subject to a possible appeal to the Swiss Federal Supreme Court.
