These Terms of Sale (hereinafter \u201cthe Terms of Sale\u201d) govern paid purchases made by Users within the Nestora mobile application: subscriptions and Mission credit packs. They supplement the Terms of Use<\/a>, which otherwise apply to any use of the Platform.<\/p>\n Nestora is a sole proprietorship with its registered office at Rue du M\u00f4le 42B, 1201 Geneva.<\/p>\n Nestora is not registered in the commercial register and is not subject to VAT.<\/p>\n Each Mission request (Client side) and each Mission acceptance (Provider side) uses a variable number of credits depending on the service category. The credit cost is displayed in the Application before the request is confirmed. The number of credits required to create or accept a mission may be increased or decreased without notice.<\/p>\n Three types of credits coexist on the User's account (Client and Provider alike):<\/p>\n Automatic refund:<\/strong> if a Mission is cancelled or expires while no Provider has been confirmed or has accepted the request, the credits used are automatically re-credited to the Client's account.<\/p>\n No refund<\/strong> in the event of cancellation by the Client while at least one Provider who accepted the Mission, or was confirmed for it, is still committed. The User is warned of this consequence before confirming the cancellation. However, if the only committed Provider withdrew of their own accord, the credits used are returned to the Client.<\/p>\n Absence of validation:<\/strong> when at least one Provider has accepted a Mission and the Client selects none of them within 2 days, the Mission is automatically cancelled and the credits used by the Client are not refunded. The Providers concerned are, for their part, re-credited.<\/p>\n Provider side:<\/strong> if the Client ultimately selects another Provider, or if the Mission is cancelled or expires before it takes place, the credits used by the Provider to accept the request are automatically re-credited.<\/p>\n All purchases are made exclusively through Apple's App Store In-App Purchase mechanism<\/strong>. Payment, invoicing, management of payment methods and delivery of the purchase receipt are handled by Apple Distribution International Ltd, in accordance with the App Store terms of use to which the User has agreed.<\/p>\n Prices are shown in Swiss francs (CHF) and include all taxes. Apple may convert the price into the User's currency at the applicable rate and fees.<\/p>\n Unless automatic renewal is disabled at least 24 hours before the end of the current period, subscriptions are tacitly renewed for an identical period. Renewal and billing are handled by Apple.<\/p>\n The User can disable automatic renewal at any time from their Apple ID settings (Settings \u2192 Apple ID \u2192 Subscriptions). Access to the subscription remains active until the end of the period already paid.<\/p>\n The purchase of a subscription or credit pack concerns digital goods delivered and executed immediately after payment. Under Swiss law (art. 40a et seq. of the Code of Obligations), the right of withdrawal specific to doorstep selling does not apply to this type of distance purchase.<\/p>\n Users residing in the European Union may nevertheless exercise a 14-day right of withdrawal with Apple in accordance with applicable European legislation. Refund requests must be addressed directly to Apple via the procedure available at reportaproblem.apple.com<\/a>. Nestora does not itself process refund requests.<\/p>\n Nestora strives to ensure the continuity of the Platform. In the event of prolonged unavailability attributable to Nestora that durably deprives the User of the benefit of their subscription, Nestora may, at its discretion, credit the account with additional subscription days or bonus credits as compensation.<\/p>\n No compensation will be due for unavailability resulting from planned maintenance, a cause external to Nestora (failure of the hosting provider, the Internet network, Apple services, etc.) or force majeure.<\/p>\n Any complaint relating to a purchase must be sent to contact@nestora.ch within a reasonable time. Nestora undertakes to respond as quickly as possible.<\/p>\n These Terms of Sale are governed by Swiss law, excluding conflict-of-law rules.
